Terms and Conditions of Sale

It is very important that You, the Customer read these Terms and Conditions of Sale very carefully, before You purchase from eBullpen. Terms and Conditions of Sale are limited to those contained in this statement. Should You convey, or attempt to convey, any additional or different Terms, by any means whatsoever, those terms are considered null and void, without notice of rejection. By registering with the Site You agree to comply with these terms and conditions.

1 When You order services from eBullpen, LLC (eBullpen.com, Bullpen, the Site, We, Us, the Company), by purchasing a registration and/or subscription with Us, You understand that a binding sale of these services is taking place and that You are liable for the cost of those services, which You have selected and have been outlined to You in processing Your order.

2 You further understand that You are providing the Company with credit card information, sufficient to identify You as the holder of the card, and to process the payment via an online merchant banking provider and charge processing company. We do not consider the sale complete, or Your order accepted, until (1) payment has been received by eBullpen; and (2) we have sent you an E-mail or other written confirmation, confirming your registration. Thus, although You may be granted access to and use of the secure area of the Site immediately upon completing registration and subscription, the sale is not final until payment has been received by Us. Should payment not be received for whatever reason, eBullpen may block Your access to and use of the Site, until payment is received. You may need to complete registration and subscription with Us, again, (re-order) in these circumstances, as the Site system may discard Your information when a payment is not completed.

3 In return for payment, eBullpen LLC is providing You with access to and use of the secure area of the Bullpen, for the purposes of facilitating online introductions between employers with open positions, and job seekers, based on personality fit and broad work experience. The secure area provides other features, such as chat rooms, but these are provided as a courtesy to members. Your payment does not secure You anything beyond this access and use, and does not guarantee that You will find a job if You are accessing as a Job Seeker, or find a worker, if You are accessing as an employer.

4 Refunds/Exchanges/warranty/cancellation

Due to the nature of its business, and the Internet, eBullpen LLC has a ‘no refunds’ policy. There is no service with which to exchange, and We warrant only that You will be given access to the secure area of the Site, provided You are not in breach of Our Terms and Conditions of Use. Although you may not cancel during the term of your subscription, Your subscription can lapse at the end of its term. If the subscription is self-renewing, then please contact Us to be sure that You are not charged a renewal. We will do everything We can to make sure that if You do not wish to renew, We will not effect that transaction. Please try to give Us reasonable notice in that case. Please do not register or subscribe with Us unless You understand and agree that any subscription/registration charge due is not refundable.

5 Governing Law

The Laws of the State of Illinois, exclusive of its conflict of law principles, will govern these Terms and Conditions of Sale. Any arbitration or litigation over the Terms and Conditions of Sale and Terms and Conditions of Use will take place in Lake County, Illinois. By registering or subscribing with Us, You understand that You are consenting and submitting to the personal and subject matter jurisdiction of the Federal and State Courts located in Lake County, Illinois.

6 International Sales

We are unable to accept any transaction from outside the United States and Canada, because our system only works with regard to proximities of US Zip codes and Canadian Postal Codes. Should a transaction somehow involve an export, You should contact Us before submitting registration or subscription information. Export or re-export contrary to United States or Illinois law is expressly prohibited.

7 Reservation of Rights

We reserve the right to change any or all of these terms and conditions at any time, without notice. In the case of any dispute as to which set of terms and conditions apply, the terms and conditions that were in force on our Site at the time of sale will be the conditions that prevail.
